What happens if you fail to declare?Failing to declare means you failed to declare everyone present in your car or boat or plane or any other type of vehicle. Also it means you failed to declare everything you acquired outside the United States. This can be any type of purchases or gifts. Before leaving or entering the U.S. be sure to visit the CBP website and read the "Know Before You Go" information on their website. You will be issued a penalty and the articles will be seized.

Do you have to declare everything at U.S. Customs?Travelers should declare all items being brought from abroad. This includes gifts and duty-free purchases. Goods purchased in a duty-free shop are not automatically free of duty upon your return to the United States.

Can I appeal a penalty issued against me?Yes, you can file a petition addressing it to the Fines, Penalties and Forfeiture Officer (FPFO) seeking them to cancel, reduce and/or ask for a payment plan.

How do you avoid getting fined when you go through U.S. Customs?Declare all items. This includes anything you purchased abroad, gifts, food items, and even medication. Declare everything accurately to avoid delays or fines. Familiarize yourself with U.S. Customs regulations. Visit the US Customs and Border Protection website for detailed information on prohibited and restricted items.

Can CBP/Border Patrol threaten to take my car if I don't pay the penalty at the moment?No law requires you to pay the penalty on the day and time it was issued. Also, CBP/Border Patrol cannot threaten you by suggesting they will take your car or property if you don't. You have time to file a petition with the FPFO appealing the penalty action and/or the amount assessed. Immediately call internal affairs at https://www.cbp.gov/about/care-and-custody/how-make-report if you are threaten. You can also call Joint Intake Center Hotline at 1-877-2INTAKE or sending a fax to (202) 344-3390.

Can I bring medical marijuana or recreational marijuana into the U.S.?No. Marijuana, used for any purpose, cannot enter the U.S. Make sure your clothing and car is completely cleaned and/or vacuumed so there is noting to be tested or detected by CBP/Border Patrol K9s.

What are Customs penalties?CBP/Border Patrol can issue a civil administrative penalty when they determine non-compliance with their rules or regulations they enforce.

What happens if you declare more than $10,000 US?There is no maximum limit, however, any amount exceeding $10,000 USD must be declared upon arrival to the U.S. or exit of the U.S. on both the Form 6059B and FinCEN 105. All forms must be filled in completely and truthfully. The penalties for inaccurate declaration and non-compliance can be severe including heavy fines and/or confiscation of funds.

What happens when Customs seizes your money?CBP/Border Patrol may seize cash if it was used for illegal activity, gained from illegal activity, or if you fail to declare the exportation or importation over $10,000. That is a total of $10,000 in your control. That means all cash on your person or in your car.

Should I respond to a Customs seizure letter?If you ignore the notice of seizure letter from CBP, CBP will note that you made no effort and you are not interested in the property seized. The property will enter administrative forfeiture processing to become property of the U.S. Government.

What is a CBP seizure?U.S. Customs may seize goods if they are contrary to law. If your merchandise is seized, you have options. In your seizure notice, you are provided a Fines, Penalties, and Forfeitures (FP&F) case number and assigned a paralegal.

How long does it take to get a seizure letter from Customs?Generally. CBP/Border Patrol must send written notice of seizure to all known interested parties as soon as practicable. In no case may notice be sent more than 60 calendar days after the date of seizure. Except, when a court grants an extension. A court of competent jurisdiction may extend the period for sending notice for a period not to exceed 60 calendar days. This period may be further extended by the court for additional 60 calendar-day periods, as necessary, See 19 CFR § 162.92(e).

Can property be seized by a state or local authority?Property is seized by a state or local law enforcement agency and turned over to CBP/US Border Patrol for the purpose of forfeiture under Federal law, notice will be sent not more than 90 calendar days after the date of seizure by the State or local law enforcement agency. See 19 CFR § 162.92 (b).
